1. Acceptance of Terms

By downloading, installing, accessing, or using QuakeLink ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

QuakeLink is a free emergency communication application designed to help users communicate during natural disasters and emergency situations when traditional communication networks may be unavailable.

2. Age Requirements

QuakeLink is intended for general audiences and is not specifically directed at children under the age of 13.

If you are under the age of 13, you may only use the App with the verifiable consent and supervision of a parent or legal guardian, as required by applicable law.

By using the App, you represent that you meet the applicable age requirements or have obtained the required parental consent.

3. Use of the Service

3.1 Permitted Use

You may use QuakeLink for:

  • Emergency communication during natural disasters and emergency situations
  • Personal, non-commercial use
  • Lawful purposes in accordance with applicable laws and regulations

3.2 Prohibited Use

You agree not to:

  • Send spam, unsolicited messages, or engage in harassment
  • Use the App for any illegal or unauthorized purpose
  • Transmit harmful, threatening, abusive, or defamatory content
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Interfere with or disrupt the App's functionality or security
  • Use the App for commercial purposes without explicit permission

4. Service Availability and Modifications

We reserve the right to modify, suspend, or discontinue the App or any part thereof at any time, with or without notice. We do not guarantee that the App will be available at all times or that it will function without errors or interruptions.

QuakeLink operates on a peer-to-peer basis and requires nearby devices to function. The App's effectiveness depends on various factors including device compatibility, network conditions, and environmental factors. We make no guarantees regarding the App's availability, reliability, or performance.

5. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The App will meet your requirements or expectations
  • The App will be uninterrupted, timely, secure, or error-free
  • The results obtained from using the App will be accurate or reliable
  • Any defects or errors in the App will be corrected

QUAKELINK IS AN EMERGENCY COMMUNICATION TOOL, BUT IT IS NOT A SUBSTITUTE FOR OFFICIAL EMERGENCY SERVICES. IN CASE OF A LIFE-THREATENING EMERGENCY, PLEASE CONTACT YOUR LOCAL EMERGENCY SERVICES IMMEDIATELY (e.g., 911, 112, etc.).

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, QUAKELINK AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of life, personal injury, or property damage resulting from the use or inability to use the App
  • Failure of the App to function during emergency situations
  • Loss of data, messages, or information
  • Interruption of business or loss of profits
  • Any other damages arising from the use or inability to use the App

In no event shall our total liability exceed the amount you paid for the App (which is currently zero, as the App is free).

YOU ACKNOWLEDGE AND AGREE THAT THE USE OF QUAKELINK IS AT YOUR OWN RISK. WE ARE NOT RESPONSIBLE FOR ANY CONSEQUENCES RESULTING FROM THE USE OR INABILITY TO USE THE APP, ESPECIALLY DURING EMERGENCY SITUATIONS.

Nothing in these Terms shall exclude or limit liability for gross negligence, willful misconduct, or any liability that cannot be excluded under applicable law.

7. Intellectual Property

The App, including its design, features, functionality, and content, is owned by QuakeLink and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

You retain ownership of any content you create or transmit through the App (such as messages). However, by using the App, you grant us a limited, non-exclusive license to use such content solely for the purpose of providing and improving the App's services.

8. Pricing and Payment

QuakeLink is currently provided free of charge. However, we reserve the right to introduce fees, subscriptions, or in-app purchases in the future. If we decide to charge for the App or any features, we will provide reasonable notice before implementing such changes.

9. Termination

We reserve the right to terminate or suspend your access to the App at any time, with or without cause or notice, for any reason, including but not limited to violation of these Terms.

You may stop using the App at any time by uninstalling it from your device. Upon termination, your right to use the App will immediately cease.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the App after such changes constitutes your acceptance of the modified Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from or relating to these Terms or the App shall be resolved through appropriate legal channels.
